These Terms of Use outline the conditions under which you may access and utilize SAIFE, along with any related services, assets, software applications, and websites provided by SAIFE Technologies, L.L.C., an Atlanta-headquartered company (collectively referred to as the "Services"). By using these Services, you acknowledge and agree to these Terms, which also incorporate our Service Guidelines and provisions for resolving disputes through binding arbitration. The user will be referred to as "User" or "You" in this agreement. The Terms of Use executes an agreement between yourself and SAIFE Technologies, L.L.C. You agree to these Terms by using our Services.

Usage of SAIFE for business and development purposes—including access to APIs and enterprise-level services—is governed by our Business Terms.

We encourage you to review our Privacy Policy, which describes how personal data is collected, used, and protected. While the Privacy Policy does not constitute part of these Terms, it provides essential context for understanding your rights and our responsibilities.

1. User Qualifications and Account Registration

(A) User Age Qualifications

To use the Services, you must be at least 13 years old. If the country where you utilize the services requires a different minimum age to consent to online services, you must meet that age instead. If you are under 18, you must have permission from your parent(s) or legal guardian(s) to use our services.

(B) Account Registration

To register for an account and use our Services, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and may not share them or allow others to access your account. You are liable for all activity that occurs under your account. You are obligated to keep your account credentials confidential and must not disclose them or permit others to use your account. If you create an account or use the Services on behalf of another individual or organization, you must have the legal authority to agree to these Terms on their behalf.

2. Your Use of Our Services

(A) Permitted Actions and Use

Your right to access and utilize our Services is conditioned upon your adherence to these Terms. When engaging with the Services, you are expected to comply with all relevant laws and regulations, as well as follow our Sharing & Publication Guidelines, Usage Policy, and any other applicable materials—such as documentation or policy notices—that we may provide.

(B) Prohibited Actions and Use

The Services must not be used to engage in unlawful, illegal, malicious, or abusive conduct. By way of illustration, the following activities are strictly prohibited:

  • Employing automated tools or scripts to extract data or Outputs (as defined below) from our Services, whether programmatically or otherwise.
  • Engaging with the Services in any manner that breaches, unlawfully appropriates, or otherwise encroaches upon the legal rights of others.
  • Altering, reproducing, renting, commercializing, or disseminating any aspect of our Services.
  • Whether directly or indirectly, attempting to reverse engineer, deconstruct, or uncover the source code or internal mechanisms of our Services—including, but not limited to, our systems, algorithms, and models—unless and only to the extent such actions are permitted under applicable law.
  • Falsely claiming or implying that any Output (as defined below) was created by a human when it was, in fact, generated by our Services.
  • Impairing or interfering with the functionality of our Services, including attempting to evade usage thresholds, operational constraints, security features, or any other protective systems or mitigations we have in place.
  • Utilizing any Output (as defined below) generated by our Services for the purpose of building, training, or enhancing models that directly or indirectly compete with SAIFE Technologies and their assets.

(C) Software Availability and Updates

Our Services may include the option to download certain software, such as mobile applications. These applications may periodically update themselves to ensure optimal performance and security. Some components of our software may incorporate open source elements, which are subject to their own respective license terms. Any such licenses will be made available to you as required.

(D) Corporate Accounts

If you register an account using an email address that is owned by an organization (such as your employer), your account may be associated with that organization's business account. In such cases, we will notify you to help coordinate the account transfer—unless your organization has previously informed you that it may monitor or assume control of your account. Once transferred, the organization's administrator will gain the ability to manage your account, including accessing your Content (as defined below), limiting your access, or revoking it altogether.

(E) Third Party Services and Outputs

Certain components of our Services may integrate or rely on third-party software, products, or services ("Third Party Services"). Additionally, features such as browsing functionality may display or generate content derived from those Third Party Services ("Third Party Output"). Both Third Party Services and Third Party Output are governed by their own independent terms and conditions. We disclaim any responsibility or liability arising from their use or performance.

4. Content

(A) User-Generated Content

By engaging with our Services, you may submit input ("Input") and receive generated results based on that content ("Output"). Together, Input and Output are referred to as "Content." You are solely responsible for the Content you provide, and you must ensure that it complies with applicable laws and with these Terms. You affirm and guarantee that you possess all necessary rights, authorizations, and legal permissions to submit Input through our Services.

(B) Content Ownership

Subject to applicable law and the terms herein, you maintain all rights, title, and interest in the Input you provide to SAIFE Technologies. Likewise, you are the sole owner of any Output generated by the Services in response to your Input. SAIFE Technologies hereby irrevocably assigns to you any and all rights, title, and interest it may hold in such Output.

(C) Content Similarities and Limits Disclaimer

Given the inherent nature of artificial intelligence and the operation of our Services, Output generated may not be unique. Similar or identical content could be provided to other users who submit comparable Input. The ownership rights we assign to you above are limited strictly to the Output generated for you, and do not extend to any output provided to others or any content developed by third parties ("Third Party Output").

(D) Our Use of Content

We may utilize Content to operate, enhance, and improve our Services, ensure compliance with applicable laws, enforce our terms and policies, and protect the integrity and security of the platform.

(E) Opting Out

If you prefer that your Content not be used to train and improve our models, you may opt out by following the steps outlined in this article. Please be aware that opting out may impact our Services' ability to enhance functionality based on your specific Input.

(F) Accuracy Disclaimer

Our AI systems aim to help users interpret and assess information, but the Output should not be construed as verified fact or objective truth. Due to the probabilistic nature of AI and evolving data sources, Output may be incomplete, inaccurate, or misleading. SAIFE Technologies does not guarantee the factual accuracy, completeness, or truthfulness of any Output. Users are encouraged to independently verify important information before acting on it.

By accessing or using our Services, you acknowledge and agree to the following:

  • Output may not always be accurate. The user should not rely on it as a sole source of truth, factual information, or as a substitute for professional advice.
  • The user is responsible for evaluating Output for accuracy, relevance, and appropriateness for their specific use case. This includes conducting human review where necessary before using or sharing Output.
  • The user must not use Output about any individual to make decisions that could have legal or material consequences for that person. This includes decisions related to credit, education, employment, housing, insurance, legal matters, medical care, or other significant areas.
  • Output may be incomplete, incorrect, or offensive, and does not reflect the views of SAIFE Technologies.
  • References to third-party products or services in Output do not imply endorsement, affiliation, or approval by those third parties or by SAIFE Technologies.

(G) Marketing and Branding Language

From time to time, SAIFE Technologies may use slogans, taglines, or promotional language such as SAIFE "Truth, made clear" or similar phrases to describe the purpose, vision, or intended use of our Services. These statements are expressions of opinion, goals, or brand identity, and are not intended to be interpreted as factual assertions, performance guarantees, or warranties.

Users acknowledge that such language is subjective and aspirational in nature, and should not be relied upon as representations of objective truth, verified accuracy, or definitive outcomes. Any reliance on marketing language is done at the user's own risk, and is superseded by the limitations, disclaimers, and terms outlined in this Agreement.

5. Medical Use Disclaimer

Our Services are not designed or intended for diagnosing, treating, curing, or preventing any medical condition. If you use the Services in a healthcare or medical context, you are solely responsible for ensuring compliance with all applicable laws, regulations, and professional standards.

6. Our Intellectual Property Rights

SAIFE Technologies and its affiliates retain all rights, title, and interest in and to the Services, including all associated intellectual property. You may not use our name, logo, or other brand assets except as expressly permitted under our Brand Guidelines.

7. Paid Accounts

(A) Billing and Payment Terms

If you purchase any Services, you agree to provide complete, accurate, and current billing information, including a valid payment method. For paid subscriptions, SAIFE Technologies will automatically charge your selected payment method at each agreed-upon renewal interval unless you cancel the subscription prior to renewal. You are responsible for all applicable taxes, and SAIFE Technologies will collect and remit taxes where required by law. In the event that a payment cannot be processed or is declined, SAIFE Technologies may downgrade your account, suspend your access to the Services, or take other appropriate action until payment is successfully received.

(B) Cancellation Policy

You may cancel your paid subscription at any time. All payments are non-refundable, except as required by applicable law. Nothing in these Terms is intended to override or limit any mandatory local laws that grant you cancellation or refund rights.

(C) Changes to Pricing

SAIFE Technologies may update its pricing structure. If we increase the price of a subscription, we will provide you with at least 30 days' advance notice. Any such price change will apply beginning with your next renewal cycle, giving you the opportunity to cancel your subscription before the new price takes effect if you do not agree to the change.

8. Termination and Suspension

You may stop using our Services at any time. SAIFE Technologies reserves the right to suspend or terminate your access to the Services, or delete your account, if we determine that you have violated these Terms or our Usage Policies, if required by law, or if your use poses a risk or potential harm to SAIFE Technologies, our users, or others. Additionally, we may terminate accounts that have been inactive for more than one year and are not associated with a paid subscription. In such cases, we will provide your account advance notice before taking action via the email listed on the account.

(A) Appeals

If you believe your account was suspended or terminated in error, you may file an appeal by contacting our Support team. Please contact our support team here.

9. Discontinuation of Services

We may also decide to discontinue our Services. Under discontinuation, we will provide you with advance notice via the email registered to your account and issue a refund for any prepaid, unused portion of the Services.

10. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis. Except where prohibited by applicable law, SAIFE Technologies and its affiliates and licensors make no representations or warranties of any kind—express, implied, statutory, or otherwise—regarding the Services. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, satisfactory quality, non-infringement, and quiet enjoyment, as well as any warranties that may arise from course of dealing or trade practice.

We do not guarantee that the Services will be uninterrupted, error-free, or completely secure. We also make no promises regarding the accuracy, reliability, or integrity of any content or data, including whether it will be preserved without loss or alteration.

Certain jurisdictions may not allow the exclusion of specific warranties. In such cases, these disclaimers will apply only to the extent permitted by law.

You understand and agree that any use of outputs generated by our Services is entirely at your own risk. You should not rely solely on these outputs for factual accuracy, decision-making, or as a replacement for professional guidance.

Outputs generated by SAIFE are provided solely for informational purposes and shall not be construed or relied upon as a substitute for professional advice, including without limitation legal counsel, medical diagnosis or treatment, financial planning or investment guidance, or any other professional or high-risk decision-making. Users remain solely responsible for obtaining appropriate professional advice before acting upon any Output.

11. Limitation of Liability

To the fullest extent permitted by applicable law, SAIFE Technologies, along with its affiliates, licensors, suppliers, and distributors, will not be liable for any indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, data, use, or other intangible losses—even if we have been advised of the possibility of such damages.

Our total liability under these Terms, for any claim arising out of or relating to your use of the Services, will be limited to the greater of:

  • The amount you paid for the specific Service that gave rise to the claim in the twelve (12) months prior to the event giving rise to liability, or
  • One hundred U.S. dollars ($100).

These limitations apply only to the extent permitted by the laws of your jurisdiction. Some states or countries may not allow the exclusion or limitation of certain damages, in which case this section will apply only to the maximum extent allowed under local law. You may have additional rights depending on where you reside.

SAIFE Technologies' affiliates, licensors, suppliers, and distributors are expressly intended third-party beneficiaries of this section and may enforce its terms directly.

12. Indemnity

If you are using the Services on behalf of a business or organization, then—to the extent permitted by applicable law—you agree to indemnify, defend, and hold harmless SAIFE Technologies, its affiliates, and their respective officers, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • The users use of the Services or Content
  • The users violation of these Terms
  • Any infringement or misuse of intellectual property, privacy, or other rights by you or your organization.

This indemnity obligation applies to third-party claims and remains in effect even after termination of your account or cessation of use of the Services. You must promptly notify SAIFE Technologies of any claims and provide reasonable cooperation in the defense.

13. Dispute Resolution

(A) Agreement to Arbitration and Class Action Waiver

If you are a user of SAIFE Technologies' Services, you agree to the following binding dispute resolution terms, including mandatory arbitration and a waiver of class actions and jury trials, to the extent permitted by applicable law. This agreement is governed by the Federal Arbitration Act ("FAA").

(B) Mandatory Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services—regardless of when the issue arose, including claims predating these Terms—must be resolved exclusively through final and binding arbitration, rather than in court. You may opt out of arbitration within 30 days of creating your account or within 30 days of any updates to these arbitration terms by submitting an opt-out request form to our support team. If you opt out of an update, the most recent version of the arbitration terms you accepted will continue to apply.

(C) Informal Resolution First

Before initiating arbitration, both you and SAIFE Technologies agree to attempt to resolve any dispute informally. You must send notice via the designated form to our support team, and we will respond using the email address associated with your account. If the dispute is not resolved within 60 days, either party may initiate arbitration. During this period, either party may request a one-on-one settlement conference, which both parties agree to attend. The statute of limitations for any claim will be paused during this informal resolution process.

(D) Arbitration Forum and Governing Law

If informal resolution fails, arbitration will be administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules or by National Arbitration and Mediation ("NAM") under its Comprehensive Dispute Resolution Rules and Procedures, as applicable. (available here.) Arbitration shall take place in Atlanta, Georgia, unless otherwise agreed, and may be conducted via videoconference when feasible. A single arbitrator—either a retired judge or a licensed attorney, or other qualified neutral—will preside. The arbitrator has exclusive authority to resolve disputes regarding enforceability, scope, interpretation, and application of this arbitration provision. Courts in Atlanta, Georgia retain jurisdiction over issues related to enforceability of the class action waiver and for requests for public injunctive relief.

(E) Arbitration Procedures

Arbitration will be conducted on an individual basis only; class actions, class arbitrations, and representative proceedings are not permitted. The arbitrator may grant dispositive motions resolving all or part of the dispute, and judgment on the award may be entered in any court of competent jurisdiction. Settlement offers will not be disclosed to the arbitrator until after a final award is issued. SAIFE Technologies will not seek attorneys' fees or costs unless the arbitrator determines your claim is frivolous.

(F) Exceptions to Arbitration

The following claims are exempt from informal resolution and arbitration:

  • (i) individual claims filed in small claims court in your county of residence; and
  • (ii) requests for injunctive or equitable relief to prevent unauthorized use of the Services or infringement of intellectual property rights.

(G) Class Action and Jury Trial Waivers

You and SAIFE Technologies agree that all disputes must be resolved on an individual basis. You may not bring claims as a plaintiff or class member in any class, consolidated, or representative proceeding. Class arbitrations and representative actions are expressly prohibited. Only individual relief is available. If public injunctive relief is sought, that request will be determined by a court, separate from arbitration of individual claims. This does not prevent participation in a class-wide settlement. You and SAIFE Technologies knowingly and irrevocably waive any right to a jury trial in any legal proceeding related to these Terms.

(H) Batch Arbitration

If a significant number of individuals (e.g., 25 or more) represented by the same or coordinated counsel file substantially similar arbitration demands within a 90-day period, NAM or AAA may, at their discretion, consolidate claims into batches of up to 50 claimants each ("Batch"), unless fewer than 50 total claimants remain. Each Batch will generally be treated as a single consolidated arbitration with one arbitrator, one set of fees, and one hearing conducted via videoconference or at a location determined by the arbitrator. If any portion of this section is found unenforceable with respect to a claimant or Batch, that portion will be severed and resolved through individual arbitration.

(I) Severability

If any provision of this dispute resolution section is found to be unlawful or unenforceable, the remaining provisions will remain in effect. However, if such a finding would permit class arbitration, class action, or representative action, then this entire dispute resolution section will be deemed unenforceable.

14. Intellectual Property and Copyright Infringement Complaints

If you believe your intellectual property rights have been violated, you may submit a formal notice either by using the form located on our support page or by sending it to the address listed below. SAIFE Technologies reserves the right to remove or restrict access to any content that, in our judgment, violates these Terms or is subject to a credible infringement claim. Where appropriate, we may also terminate the accounts of users who repeatedly infringe intellectual property rights.

If you believe that content on our Services infringes your copyright, you may submit a written notice that includes all of the following required information:

  • A physical or electronic signature of the person authorized to act on behalf of the copyright owner.
  • A description of the copyrighted work you believe has been infringed.
  • A description of the location of the allegedly infringing material on our Services, sufficient for us to identify and locate it.
  • Your contact information, including your mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.

Please submit your notice using this form or send it to the address provided in our contact section. SAIFE Technologies may remove or disable access to content that is alleged to be infringing and may terminate accounts of repeat infringers, where appropriate.

15. General Terms

Users are responsible for regularly reviewing these Terms and any updates. Continued use of the Services after updates constitutes acceptance of the revised Terms.

(A) Assignment of Rights

You may not assign or transfer any rights or obligations under these Terms without our prior written consent. Any attempted assignment or transfer without such consent will be null and void. SAIFE Technologies may freely assign or transfer its rights and obligations under these Terms to any affiliate, subsidiary, or successor entity in connection with a merger, acquisition, corporate reorganization, or sale of assets related to the Services.

(B) Changes to These Terms or Our Services

We continuously improve and evolve our Services. As part of this process, we may update these Terms or modify the Services as needed. Updates may be made for reasons including, but not limited to:

  • Compliance with changes in applicable laws or regulatory requirements
  • Enhancing security or safety
  • Responding to events beyond our reasonable control
  • Advancing the Services in the ordinary course of development
  • Adapting to new technologies

If a change to these Terms materially and adversely affects your rights, we will provide at least 30 days' advance notice via email or in-product notification. Material changes to these Terms or Services will be communicated via: email to the address associated with your account, and/or in-product or in-service notifications. Posting updates on our website also constitutes notice. If you do not agree to the updated Terms, you must discontinue use of the Services.

(C) Enforcement Delay

If SAIFE Technologies chooses not to enforce any provision of these Terms at any time, it does not waive the right to enforce that provision in the future. All provisions remain fully enforceable to the maximum extent permitted by law. Except as stated in the dispute resolution section, if any part of these Terms is found to be invalid or unenforceable, it will still be enforced to the fullest extent allowed by law, and the rest of the Terms will remain fully effective.

(D) Compliance with Trade Laws

The user agrees to follow all applicable trade laws, including export control and sanctions regulations. You may not use, export, or re-export our Services:

  • To any country or territory subject to U.S. embargoes
  • To any person or organization restricted under applicable trade laws
  • For any prohibited end use under those laws

Additionally, you must not submit any content or information that requires a government license for release or export.

(E) Entire Agreement

These Terms represent the complete and exclusive agreement between you and SAIFE Technologies concerning your use of the Services. Except for any additional terms that apply to specific Services, these Terms override all prior or simultaneous agreements, communications, or understandings between you and SAIFE Technologies.

(F) Governing Law

These Terms are governed by the laws of the State of Georgia, excluding its conflict of laws principles. Except as otherwise provided in the dispute resolution section, any claims or disputes arising out of or relating to these Terms shall be resolved exclusively in the state or federal courts located in Atlanta, Georgia.
